The Responsibility of Firms to Secure Personal Information Under the Data Protection Act

As holders of client sensitive information, all businesses have a legal obligation to adhere to the Data Protection Act (DPA). For a company to be compliant with the DPA, they must ensure that appropriate measures are taken to guard against unauthorised or unlawful access to or use of personal data. As such, the implementation of strong and well enforced data security guidelines is vital.

Data security guidelines should broadly divide into two categories: technical and organisational. Technical protection of data involves the installation of security programmes such as firewalls and antivirus software, which block unauthorised access to the computer network and help to prevent the installation of malware such as Trojan horses that can give malicious users access to and control of infected computer systems.

Organisational measures to properly guard against unauthorised or unlawful use of personal data typically take the form of an acceptable use policy. Such a policy should control the way in which staff access and use sensitive data. In addition to the potentially serious damage to a company’s reputation, the Information Commissioner’s Office can impose a fine of up to 5,000 GBP, and such a loss may also incur the wrath of other regulatory bodies. In 2007, Nationwide Building Society was fined nearly 1 million GBP by the Financial Services Authority following the theft of a laptop that contained confidential customer data from an employee’s home. Further, if injured parties choose to take their case to civil court, there is no limit to the potential damages that could be awarded.

As businesses increase their online presence and dependency on IT, the number of incidents of computer misuse continues to rise. To limit the occurrence of such incidents, acceptable use policies and security measures must be implemented, but when controls are bypassed, either intentionally or unintentionally, organisations must be prepared to act quickly and effectively to minimise their impact.

Where an incidence of computer misuse is suspected, such as the theft of intellectual property, computer forensics experts are often called in, who are able to analyse computer equipment in order to produce legal evidence. For this procedure to be effective, any members of staff responsible for dealing with a computer related incident should be fully trained on how to handle evidence and all members of staff should be made aware of each other’s role, responsibilities, and capabilities in this regard.

The main aim of these measures is to prevent an operational security problem from becoming a business problem that impacts on revenue and services. For example, if an incident of computer misuse is seen to have occurred but cannot be proved due to contamination of evidence, this could lead to a costly wrongful dismissal payout at an employment tribunal. Equally, if evidence is lost, the identities of those involved may not be found, which could leave the company exposed to future attacks.

For the reasons described above, it is never too early to put incident response training in place, since waiting until an incident has occurred is, of course, too late to ensure that it is addressed effectively. In addition, having visible measures in place to tackle such events has the added benefit of acting as a deterrent against computer misuse, making it an effective way to reduce the number of computer related incidents and the resulting cost to your company.
